Terms of Service

These terms are the agreement between you and CRTYX HOLDINGS LIMITED for use of Flash. By creating an account you accept them.
1. Who these terms are for
Two very different people accept these terms. Artists and studios run their business on Flash and may pay us a subscription. Clients hold a free account so they can send a booking request and talk to their artist, and nothing more.
Where a section applies to only one of them it says so. If you are booking a tattoo, the sections on subscriptions and on your responsibilities as a data controller are not about you, and the limits in sections 7 to 9 do not cut across your rights as a consumer.
2. What Flash is
Flash is booking and admin software for tattoo artists and studios. It holds your enquiries, appointments, client messages, deposit records, guest spots and your own consent form.
We are not a marketplace and not a payment processor. We do not take commission, we do not handle money between you and your clients, and we are not party to any tattoo booking made through the platform. The agreement to do the work is between the artist or studio and their client. Deposits and fees are arranged and taken by you, directly, however you choose; Flash only records what you tell it.
3. Your account
You must be 18 or over to hold an account. Keep your login details to yourself and tell us promptly if you think someone else has them. You are responsible for everything done through your account, and for anything your studio's staff do with the access you grant them.
Give us accurate information and keep it current. A verified badge is granted only after we have manually reviewed the details you submit; we may withhold or withdraw it at our discretion. Until an account is verified it can receive booking requests but cannot reply to clients or sell instant booking days.
4. Subscriptions and payment (artists and studios)
Paid plans are £29.99 per month for a solo artist and £124.99 per month for a studio, including VAT, with 5 artist seats on the studio plan. Subscriptions renew monthly until cancelled and you can cancel at any time from your dashboard; cancellation takes effect at the end of the period you have paid for.
While Flash is in beta it is free of charge. We will give reasonable notice before that changes, and you will never be charged without agreeing to a plan first. Prices may change on notice; a change never applies to a period you have already paid for.

5. Your content and your clients (artists and studios)
Your profile, portfolio, client list and messages remain yours. You grant us only the licence we need to host and display them so the service works, and nothing more. We do not sell your data, and we do not market to your clients.
For the client records you keep here you are the data controller and we act as your processor. What that means in practice — what we may do with the data, who else touches it, and what happens to it when you leave — is set out in our Data Processing Agreement, which forms part of these terms. You are responsible for having a lawful basis to hold that information, for the accuracy of what you upload, and for holding the rights to any images you publish.
Consent forms are not stored by us. You build your own form here, but the completed copy is saved to your own device and never uploaded. Keeping those records for as long as your insurer or local authority requires is entirely down to you.
6. Acceptable use
Do not use Flash to break the law, to harass anyone, to impersonate another artist or studio, to send unsolicited marketing, or to interfere with the platform's security or availability. Do not upload anything you do not have the right to upload.
We may suspend or close an account that breaches these terms, that is used fraudulently, or where we are required to by law. Where it is reasonable to do so we will tell you why and give you a chance to get your data out first.
7. Availability
We work to keep Flash available and quick, but we do not promise uninterrupted service. We may change, suspend or withdraw features, and during beta the service may change substantially. Reminders depend on email and SMS providers we do not control, so treat them as a helpful nudge rather than a guarantee that a client will turn up.
For business users, Flash is provided as it is and as it is available. We exclude all implied warranties, conditions and terms, including satisfactory quality, fitness for a particular purpose and non-infringement, to the fullest extent the law allows. We do not warrant that the service will be uninterrupted or error free, or that it will meet your particular requirements.
If you are a consumer, the paragraph above does not apply to you. You keep every right the Consumer Rights Act 2015 gives you, including that a service is supplied with reasonable care and skill.
8. Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
If you are booking a tattoo as a consumer, the cap in the next paragraph does not apply to you. We are liable to you for loss we cause that is a foreseeable result of our breaking these terms or failing to use reasonable care, and nothing here takes away any right you have under consumer law.
If you use Flash for your business, then subject to the paragraph above we are not liable for lost profit, lost bookings, lost goodwill or lost data, or for any indirect or consequential loss, and our total liability to you for all claims in any twelve month period is capped at the greater of the fees you paid us in that period and £100.
Either way, we are not responsible for the conduct of any artist, studio or client, for the tattoo work itself, or for any dispute or deposit arrangement between them. The agreement to do the work is not ours.
9. Your indemnity (artists and studios)
You keep control of what you put here: your portfolio images, your client records, and what you tell your clients about how you use their data. So if someone brings a claim against us because of it, you cover us for it.
Specifically, you indemnify us against reasonable losses, damages and costs from any third-party claim arising out of the content you upload, your breach of these terms, or your handling of your clients' personal data. We will tell you promptly about any such claim, not settle it without asking you first, and let you take over the defence if you want it. This section does not apply to consumers.
10. Ending the agreement
You can close your account at any time from your dashboard. Doing so anonymises your personal details; bookings survive as anonymised records because artists need their own business records to stay intact. Export your data before you go, the option is in your settings.
11. General
These terms are governed by the law of England and Wales. For business users, the courts of England and Wales have exclusive jurisdiction. If you are a consumer, you keep the right to bring proceedings in the courts of the country you live in, and nothing here changes that. If any part of these terms is unenforceable the rest stands. We may update them; material changes will be notified in the app or by email before they take effect.
